    I think its a fair defense, who is to say that just because he demanded nuts and got up and down a lot, and cussed at a FA that he was that large of a risk. His activities seem odd but he was not physically violent. I think someone could argue that just because he was demanding and nasty that doesn't make him responsible for the actions of the pilot.

    However, the constable acknowledged that "no one was struck" during the flight.

    These are "sensitive" times, I guess. Plus the action by the pilot could be attributed to such sensitivities surrounding air travel in this day and age. It's best to behave when in the sky. We will see how this case progresses.
